Privacy Policy
The company BIZON.expert, with its head office at Ormoška cesta 21, 9240 Ljutomer, Slovenia, European Union, registration number 8040397000, tax number: 23373989, hereinafter referred to as “BIZON.expert,” aims to protect the privacy of individuals using its services (“customers”) and other persons whose data it processes (hereinafter collectively referred to as “individuals”). These Data Protection Terms are issued in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, and the Personal Data Protection Act (as amended). The Terms describe BIZON.expert’s personal data protection policy, outline the types of data processed, storage duration, purposes, and the rights of individuals in relation to their personal data and processing. They supplement the BIZON.expert Terms of Business and apply to all cases where BIZON.expert acts as a controller of individuals’ personal data.
1. Processing of Personal Data
BIZON.expert processes individuals’ personal data based on legal obligations, contracts, legitimate interests, and/or voluntary consent.
BIZON.expert processes the following data about clients for the purpose of providing services: name and surname for natural persons; company name and organizational form for legal entities; address/registered office; contact telephone number; academic, scientific, or professional title (if requested by the individual); website address and other personal contact information; email address; tax number for natural persons; tax and registration numbers for legal entities; an address for invoice delivery if different from the permanent address (street/settlement, postal code, city); transaction account number for individuals; and additional payment-related data if requested by the client, provided it does not infringe on the rights of third parties.
BIZON.expert will process and store the personal data mentioned above until all services have been fully paid for. If required by tax legislation, certain data will be retained for a 10-year period.
With the express consent of individuals, BIZON.expert collects, stores, uses, and segments personal data—including name, surname, address, email address, contact telephone number, customer number, traffic data, and non-traffic-related location data—for the following purposes:
- Targeted notifications of offers and benefits for potential new services, not exceeding 10 years, via SMS, MMS, email, mail, or telephone;
- Notifications about prize games organized by BIZON.expert or its partners, via SMS, MMS, email, mail, or telephone;
- Surveys regarding customer satisfaction and additional services, via SMS, MMS, email, mail, or telephone.
Personal data will be retained only for as long as necessary to achieve the purposes outlined above or until the individual withdraws their consent.
BIZON.expert has a legitimate interest in using personal data to enhance, customize, or improve its services, detect and prevent fraud, enhance website security, send beneficial messages to individuals, and analyze the effectiveness of marketing communications.
2. Transfer of Data to Third Parties
To fulfill its contractual obligations, BIZON.expert may transfer individuals’ personal data to external service providers and suppliers, including affiliated companies. These third parties have signed appropriate contracts with BIZON.expert for the processing of personal data.
3. Rights of Individuals
This section summarizes the rights individuals have in relation to their personal data under applicable laws and these Terms. Some rights include additional specifics not covered in this summary, which are detailed in the primary legal framework. Under the applicable laws and these Terms, individuals are entitled to:
- (a) access personal data;
- (b) request rectification of inaccurate personal data;
- (c) request erasure of personal data;
- (d) restrict the processing of personal data;
- (e) object to processing for specific purposes;
- (f) request data portability;
- (g) lodge a complaint with a supervisory authority;
- (h) withdraw consent for data processing.
Access
Individuals have the right to confirm whether their personal data is being processed. Where such data is being processed, they are entitled to access it, along with additional details, such as the purpose of processing, categories of data processed, and the recipients of the data. Where this does not affect the rights and freedoms of third parties, BIZON.expert will provide individuals with a copy of their personal data.
Rectification
The individual has the right to have inaccurate personal data rectified and, where appropriate, to have incomplete data completed.
Erasure
In certain circumstances, the individual has the right to have personal data erased without undue delay. These circumstances include the following:
- The personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
- The individual withdraws consent to the processing of personal data where consent was the legal basis for processing;
- The individual objects to the processing of personal data for direct marketing purposes based on the legitimate interest of the processor;
- The processing of personal data lacks appropriate legal grounds.
Notwithstanding a request for erasure, BIZON.expert is not obliged to delete personal data if processing is necessary for the exercise of the right to freedom of expression and information, compliance with legal obligations, or the establishment, exercise, or defense of legal claims.
Restriction of Processing
The individual has the right to restrict the processing of personal data in the following circumstances:
- When the individual disputes the accuracy of the data and exercises the right to rectification;
- When the data are being processed without proper legal grounds, but the individual opts for restriction rather than deletion;
- When BIZON.expert no longer needs the personal data for the purposes specified in Article 2, but the individual requires the data for the establishment, exercise, or defense of legal claims.
In these cases, BIZON.expert will store the personal data but will not process them further, except with the explicit consent of the individual or when processing is necessary for the establishment, exercise, or defense of legal claims, protection of the rights of a third party, or reasons of overriding public interest.
Objection to Processing
The individual has the right to object to the processing of personal data for reasons relating to their specific circumstances, provided that the processing is based on the performance of a task carried out in the public interest, the exercise of official authority, or legitimate interests pursued by BIZON.expert or a third party.
If such an objection is raised, BIZON.expert will cease processing unless it can demonstrate compelling legitimate grounds for processing that override the individual’s interests, rights, and freedoms, or if processing is required for the establishment, exercise, or defense of legal claims.
The individual also has the right to object to the processing of personal data for direct marketing purposes. Upon such an objection, BIZON.expert will immediately cease processing for these purposes.
Additionally, the individual may object to the processing of personal data for research, scientific, or statistical purposes unless the processing is necessary for a task carried out in the public interest.
Portability of Personal Data
If the legal basis for processing personal data is the explicit consent of the individual or the necessity for the performance of a contract with BIZON.expert (or the preparation for such a contract), and the processing is automated, the individual has the right to receive their personal data in a structured, commonly used, and machine-readable format.
This right does not apply if its exercise would adversely affect the rights and freedoms of third parties.
Complaint to the Supervisory Authority
The individual has the right to file a complaint with the supervisory authority for data protection in the EU country of their permanent residence, employment, or the country where they believe a violation has occurred.
Withdrawal of Explicit Consent to the Processing of Personal Data
When the processing of personal data is based on the explicit consent of the individual, they have the right to withdraw their consent at any time.
Withdrawal of consent does not affect the lawfulness of processing conducted prior to the withdrawal or the validity of consent-based processing during its effective period.
4. Legal Entities
A customer who is a legal entity, sole proprietor, or other organization that conducts business with BIZON.expert on its own behalf, and where the actual individual using the services is a member of such organization or uses the services under authorization from the organization (hereinafter referred to as the “organization”), is obliged, upon commencing business with BIZON.expert, to inform all individuals using BIZON.expert’s services about these Terms and the purposes for which BIZON.expert and its contractual processors will process their personal data.
An organization that has entered into a contract with BIZON.expert for the provision of services is, if necessary, required to obtain all necessary consents from individuals using BIZON.expert’s services, enabling BIZON.expert to process personal data in the execution of the contract. The organization is further obliged to ensure that individuals using BIZON.expert’s services consent to the following:
- the transmission of certain personal data of the individual to the organization,
- the processing of traffic data and location data (which are not simultaneously traffic data) necessary for the provision of additional services,
- and any other necessary consents.
The organization, as a client of BIZON.expert’s services, must provide BIZON.expert with access to all consents obtained from individuals that BIZON.expert requires for processing personal data.
